Fairquery Terms of Service
These terms cover your use of the tools, APIs, software, data, digital products and website offered under the Fairquery name (together, the "services").
Who we are. Fairquery is a brand name. The services are provided by the individual who operates the Fairquery brand as a sole proprietor based in Florida, USA. "Fairquery", "we", "us" and "our" mean that operator and any successor, including any business entity the operator forms to run Fairquery and to which these terms are assigned. "You" means the person or organization using the services. Contact: fairquery@proton.me.
Please read sections 13 to 15 and 18 carefully. They disclaim warranties, limit our liability, require you to cover certain losses, and waive jury trials and class actions.
1. Accepting these terms
By accessing or using any service, buying a Fairquery product, or clicking or checking a box to accept these terms, you agree to them. If you don't agree, don't use the services.
- If you use the services for an organization, you confirm you are authorized to accept these terms for it, and "you" includes that organization.
- If you let an AI agent, script, workflow or other automated system use the services for you, you are responsible for everything it does as if you did it yourself, and these terms apply to that use.
- You must be at least 18 years old and able to form a binding contract. The services are intended for business and professional use. They are not directed to children, and you must not submit data you know comes from a child under 13 unless you are legally permitted to do so.
2. What Fairquery offers
- Apify Store Actors: SEC EDGAR company facts and filings, OSV dependency vulnerability check, email validator (MX, disposable and typo checks), website tech/SEO/AI-readiness, LLM data guard (PII and secrets redaction), website contact and company enricher, and sanctions and watchlist screener (OFAC, EU, UK, UN).
- RapidAPI listings: Email Validator, Website Intelligence and Sanctions Screening, including a small, capped free tier.
- Open-source software: the
@fairquery/agent-trust-mcpMCP server and other code on GitHub and npm. - Gumroad digital products: prompt packs, n8n and Zapier workflow packs, and a starter kit.
- The blog at https://fairquery.github.io.
Descriptions of the services on the blog, in listings, READMEs and documentation describe how the services are designed to work at the time of writing. They are not promises or warranties, and features may change.
3. Which terms apply, and platform terms
Fairquery is sold through third-party platforms. Their terms apply alongside these, and they handle billing, payments and refunds:
- Apify Store Actors. Your use of an Actor on Apify is governed by the end-user terms shown on that Actor's Apify Store listing (by default, Apify's Standard Actor Contract). For Actors, these Fairquery terms apply only as additional rules of use to the extent they are consistent with those end-user terms; if they conflict, the Actor's end-user terms win. Apify bills Actor usage on a pay-per-event basis under Apify's terms and pricing.
- RapidAPI listings. RapidAPI's terms govern your RapidAPI account, billing and quotas. These Fairquery terms govern your use of the Fairquery APIs themselves.
- Gumroad products. Gumroad processes payments as the seller of record under its terms. Refunds follow the refund policy shown on the product page and Gumroad's terms.
- npm, GitHub and other code hosts. Their terms apply when you download code from them, and section 10 covers open-source licenses.
If a platform's terms conflict with these about billing, payment or refunds, the platform's terms win. Refund requests go to the platform you bought through. Fairquery does not control the platforms and is not responsible for their acts, outages or policies.
4. Acceptable use
You agree not to, and not to let anyone (or any agent) acting for you:
- use the services for anything unlawful, or to help anyone else break the law;
- harass, stalk, dox or spam anyone, or use contact or email data for unsolicited messaging that breaks anti-spam, telemarketing or privacy laws (see section 7);
- use any output as a factor in deciding a person's eligibility for credit, insurance, employment, housing, tenancy or any other purpose covered by the US Fair Credit Reporting Act or similar laws (see section 6);
- make other decisions that significantly affect individuals (for example account closure, fraud blocking or access to services) based on Fairquery output without meaningful human review;
- exceed rate limits or quotas, or try to bypass free-tier caps, billing or usage metering (for example by creating multiple accounts);
- reverse-engineer, probe, overload or attack the hosted services or other Fairquery infrastructure, except good-faith security research on Fairquery's own code and endpoints that follows our security page (https://fairquery.github.io/security/), avoids other people's data, and does not degrade the service. This does not authorize testing of Apify, RapidAPI or any other third party's systems;
- resell or redistribute raw output from the hosted services as a competing API or data feed;
- share your API keys or tokens beyond your organization, or use someone else's without permission (you are responsible for activity under your keys and accounts);
- send malware, or content or data you have no right to process.
We may investigate suspected breaches and may cooperate with platforms or authorities where we believe it is required or appropriate.
5. Results are screening aids, not advice
Sanctions and watchlist screening, vulnerability checks, email risk flags, PII and secret detection, company data and similar results are informational aids. They are not legal, compliance, financial, investment, security or other professional advice, and they are not a substitute for your own due diligence.
- Matching and detection are imperfect. False positives (flagging someone or something that isn't a match) and false negatives (missing a real match) happen, especially with fuzzy name matching, transliteration, common names, unusual formats and non-English text. Redaction may miss sensitive data.
- A human must review any potential match or finding before you act on it.
- You stay responsible for your own decisions and for your compliance obligations.
- Don't rely on AI-generated or automated output alone. If an AI agent or model calls, summarizes or acts on Fairquery output, it may misread or misstate it. Check important results against the original sources.
6. Sanctions screening, sanctions compliance and FCRA
Screening tools. The sanctions screener checks names against the OFAC, EU, UK and UN lists it can download at the time of the run. It does not cover every sanctions list or regime, politically exposed persons, adverse media, or ownership and control (for example, entities owned 50% or more by sanctioned persons can be blocked without being listed by name). Lists can change at any time and a source may be delayed or unavailable. Using the screener does not make you compliant with any law, and Fairquery is not your compliance provider.
Your own sanctions and export compliance. You represent and agree that:
- you are not, and are not owned or controlled by or acting for, any person on a US, EU, UK or UN sanctions list (including OFAC's Specially Designated Nationals and Blocked Persons List);
- you are not located in, ordinarily resident in, or organized under the laws of a country or region subject to comprehensive US sanctions (as of the date above, these include Cuba, Iran, North Korea, and the Crimea, so-called Donetsk People's Republic and so-called Luhansk People's Republic regions of Ukraine; OFAC's current program list controls);
- you will not use, export, re-export or transfer the services or output in violation of US or other applicable sanctions or export control laws, or for any prohibited end use.
We may block, suspend or end access without notice if we believe these laws require it or that you are in breach.
Not a consumer reporting agency. Fairquery is not a "consumer reporting agency" under the Fair Credit Reporting Act (FCRA), and the services do not provide "consumer reports". You must not use any Fairquery service or output, alone or combined with other data, to decide a person's eligibility for credit, insurance, employment, housing or tenancy, or for any other FCRA permissible purpose, and must not use it for background checks. If you do, you breach these terms, and you are solely responsible for complying with the FCRA.
7. Email validation, contact enrichment and website data
Email validation is probabilistic. The email validator checks syntax, DNS and MX records, disposable, role and free-provider lists, and likely typos. It does not send email or confirm that a mailbox exists. A "valid" result means the address looks deliverable, not that it will receive mail or that you may contact it.
Contact enrichment and website tools. These tools fetch publicly accessible pages of websites you choose. You are responsible for:
- having the right to collect and use data from those websites, including following their terms and any applicable computer-access, privacy and intellectual property laws;
- treating returned contact details (which can include named business emails and phone numbers) as personal data where the law does, and having a lawful basis to process them;
- complying with anti-spam and telemarketing laws when you contact anyone, including CAN-SPAM, the TCPA, the Florida Telephone Solicitation Act, do-not-call rules, Canada's CASL and EU/UK ePrivacy rules (PECR), and honoring opt-outs.
You must not use the services to harvest addresses for unlawful commercial email, to send email to addresses obtained from websites that say their addresses may not be shared, or to make autodialed, prerecorded or artificial-voice calls or texts without the consent the law requires. Validation and enrichment results are not consent to contact anyone.
8. Third-party data sources
Some tools rely on public sources run by others, such as SEC EDGAR, OSV.dev, Cloudflare DNS, the websites you choose and government sanctions lists (OFAC, EU, UK, UN). We don't control them. Their data may be incomplete, delayed, wrong or temporarily unavailable, may carry its own license or usage terms (for example, the SEC's fair-access rules), and may change format or access rules without notice. Check original sources for anything important. SEC data and company information are not investment advice.
9. Your inputs and personal data
- You are responsible for the data you send to the services, for having the right to use it, and for the lawfulness of your instructions.
- If your inputs include personal data (such as names, email addresses or documents), you decide why and how it is processed. You must have a lawful basis, give any notices and get any consents the law requires, and handle requests from the people concerned. Where data-protection law uses these concepts, you are the controller (or "business") and Fairquery processes that data only on your behalf to provide the service you asked for.
- For Apify Actors, the data-protection terms in the Actor's end-user terms apply.
- Only send the data the task needs. Don't send highly sensitive data (such as health data, government ID numbers or payment card numbers) unless a tool is designed for it, such as the PII redaction tool, and only where you are allowed to.
- We don't sell your inputs or results, and we don't use them to train AI models.
- How the tools are designed to handle data is described on our security page (https://fairquery.github.io/security/). In short: free MCP tools run on your machine; paid tools run in your own Apify account under its storage and retention settings; the RapidAPI gateway is designed to process requests in memory without writing inputs or results to storage. That page describes current design and practice, not a guarantee, and may change.
- Platforms keep their own records. Apify, RapidAPI, Gumroad, GitHub, npm, Cloudflare and other providers process and log data under their own terms and privacy policies, which we don't control. We may also keep limited operational data, such as request metadata (method, path, status, timing), platform account identifiers used to enforce quotas, and support emails you send us.
- No system is perfectly secure. We do not promise that data will never be lost, exposed or intercepted.
- We may disclose information if we believe the law, legal process or a platform requires it, or to protect the services, users or others.
10. Open-source software
Open-source parts of Fairquery, including @fairquery/agent-trust-mcp (MIT license), are governed by their own licenses. If a license conflicts with these terms for that code, the license wins for that code. Free MCP tools run on your machine. Paid MCP tools call Apify with your own Apify token, so Apify's terms, the Actor's end-user terms and Apify billing apply to those calls.
11. Digital products, ownership and feedback
- Digital products. Gumroad products are licensed, not sold, for your own use and for use in your own or your clients' projects. Don't resell, share or redistribute them as-is, or in a lightly modified form, unless the product page says otherwise. Workflows and prompts are examples: test them before relying on them.
- Ownership. Except for open-source code under its own license, Fairquery and its licensors keep all rights in the services, software, documentation and products. Subject to these terms and third-party rights in source data, you may use the output you receive for your lawful purposes.
- Feedback. If you send us ideas or suggestions, we may use them without any obligation to you.
- Intellectual property complaints. If you believe content we publish infringes your rights, email fairquery@proton.me with the work, the material, where it appears, your contact details, and a statement that you believe in good faith the use is not authorized. We may remove material and may end access for repeat infringers.
12. Availability, changes and suspension
The services may be unavailable, slow, changed or discontinued at any time, and we don't promise any uptime, support or response times. We may change, pause or stop any service, feature, free tier, limit or price at any time. Price changes on a platform follow that platform's rules. We may limit, suspend or block access, with or without notice, for abuse, suspected abuse, breach of these terms, legal or sanctions risk, security risks, non-payment, or if a platform or the law requires it.
13. No warranties
THE SERVICES, SOFTWARE, DATA, OUTPUT AND PRODUCTS ARE PROVIDED "AS IS", "AS AVAILABLE" AND "WITH ALL FAULTS". TO THE FULLEST EXTENT THE LAW ALLOWS, FAIRQUERY DISCLAIMS ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WITHOUT LIMITING THE ABOVE, FAIRQUERY DOES NOT WARRANT THAT THE SERVICES OR OUTPUT WILL BE ACCURATE, COMPLETE, CURRENT, RELIABLE, SECURE, UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL CODE, THAT ANY MATCH, FINDING OR REDACTION WILL BE CORRECT, OR THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR ANY LEGAL OR COMPLIANCE OBLIGATION. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN (INCLUDING ON THE BLOG, LISTINGS, DOCUMENTATION OR SECURITY PAGE), CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
IF THE LAW DOES NOT ALLOW A WARRANTY TO BE DISCLAIMED, THAT WARRANTY IS LIMITED TO THE SHORTEST PERIOD AND NARROWEST SCOPE THE LAW ALLOWS.
14. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, AND WHATEVER THE LEGAL THEORY (CONTRACT, WARRANTY, TORT INCLUDING NEGLIGENCE, STRICT LIABILITY, STATUTE OR OTHERWISE):
- FAIRQUERY IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL OR BUSINESS OPPORTUNITIES, OR FOR FINES, PENALTIES OR COSTS OF SUBSTITUTE SERVICES, EVEN IF WE WERE TOLD THEY WERE POSSIBLE;
- FAIRQUERY IS NOT LIABLE FOR ANY LOSS ARISING FROM YOUR (OR YOUR AI AGENT'S) RELIANCE ON OUTPUT, YOUR COMPLIANCE DECISIONS, THIRD-PARTY DATA SOURCES, OR THE ACTS OR OUTAGES OF APIFY, RAPIDAPI, GUMROAD OR OTHER THIRD PARTIES;
- FAIRQUERY'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$100.
THESE LIMITS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE, AND THEY ALSO PROTECT FAIRQUERY'S OPERATOR AND ANY CONTRACTORS. THEY ARE AN ESSENTIAL BASIS OF THE BARGAIN: THE SERVICES ARE OFFERED AT LOW OR NO COST BECAUSE OF THEM.
Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, such as liability for fraud, intentional misconduct or, where the law requires, gross negligence or death or personal injury caused by negligence. Some places don't allow certain limits, so some of these may not apply to you.
15. Indemnity
To the fullest extent the law allows, you agree to defend, indemnify and hold harmless Fairquery and its operator and contractors from and against all third-party claims, and all resulting losses, damages, fines, penalties, settlements and reasonable costs (including legal fees), arising out of or relating to: your inputs; your use of the services or output (including use by any AI agent or automated system acting for you); decisions you make based on output; your contact with any person using data from the services; your breach of these terms; or your violation of any law or anyone else's rights. This applies even if a claim alleges that Fairquery was also negligent, but not to the extent a claim is caused by Fairquery's own intentional misconduct. We may choose to control the defense of any claim at your cost, and you may not settle a claim that imposes obligations on us without our written consent.
16. Ending these terms and survival
You can stop using the services at any time. We may end or suspend your access as described in section 12. Sections 4 to 9, 11 and 13 to 21, and any other terms that by their nature should continue, survive after your use ends.
17. Governing law and where disputes are heard
These terms, and any dispute about them or the services, are governed by the laws of the State of Florida, USA, and applicable US federal law, without regard to conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods does not apply.
Except as section 18 says, disputes will be heard only in the state or federal courts located in Florida, and you and we consent to their jurisdiction. Either party may also bring an individual claim in a small-claims court that has jurisdiction, and either party may seek urgent injunctive relief in any competent court to protect intellectual property or the security of the services. If you are a consumer, this section does not take away mandatory consumer protections of the place where you live, where those apply to you by law.
18. Resolving disputes
Informal resolution first. Before starting any formal proceeding (other than small claims or urgent injunctive relief), the party with a dispute must send a written notice describing it and the relief sought: to us at fairquery@proton.me, or to you through the contact details we have or the platform you used. We will both try in good faith to resolve it for 30 days after the notice is sent.
JURY TRIAL WAIVER. TO THE FULLEST EXTENT THE LAW ALLOWS, YOU AND FAIRQUERY KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY LAWSUIT ABOUT THESE TERMS OR THE SERVICES.
CLASS ACTION WAIVER. TO THE FULLEST EXTENT THE LAW ALLOWS, YOU AND FAIRQUERY MAY BRING CLAIMS AGAINST EACH OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE ACTION. If this waiver is found unenforceable for a claim, that claim may proceed only in the courts named in section 17.
19. Changes to these terms
We may update these terms. We will post the updated version on this page with a new "Last updated" date. For material changes, we will also make reasonable efforts to flag the change (for example, on the blog or the relevant listing) at least 14 days before it takes effect, unless a shorter time is needed for legal, security or platform reasons. Changes apply only going forward: they do not apply to disputes that arose, or claims that were notified, before the change took effect. If you continue to use the services after a change takes effect, you accept the updated terms. If you don't agree, stop using the services.
20. General
- Whole agreement and order of precedence. These terms, together with the applicable platform terms, Apify Actor end-user terms, open-source licenses and product-page license terms described above, are the whole agreement between you and Fairquery about the services.
- Severability. If any part of these terms can't be enforced, it will be enforced to the maximum extent allowed, and the rest still applies.
- No waiver. If we don't enforce a right immediately, we haven't given it up.
- Assignment. You may not transfer these terms without our written consent. We may transfer them, including to a business entity formed by the operator or to a buyer of the business, without your consent.
- Force majeure. We are not responsible for delays or failures caused by events beyond our reasonable control, such as outages of platforms, hosting, DNS or data sources, internet failures, cyberattacks, government action, illness, or natural disasters.
- Relationship. Nothing in these terms creates a partnership, agency, employment or fiduciary relationship. Except for the protections given to Fairquery's operator and contractors, no one else has rights under these terms.
- Electronic notices. You agree that we may give notices electronically, including by posting them on this site or a listing, or by email, and that electronic notices satisfy any requirement that notices be in writing.
- Headings and examples. Headings are for convenience, and "including" and "for example" mean "including without limitation".
